  • JobRoad ivzw, with registered office at Beversesteenweg 576, 8800 Roeselare, Belgium, and registered with the Crossroads Bank for Enterprises under number 0736.428.156 (hereinafter: ‘JobRoad’), processes personal data of certain persons (hereinafter ‘Data Subjects’) as a ‘controller’.This privacy statement (hereinafter referred to as the ‘Privacy Statement’) explains how the personal data of Data Subjects is processed (including when using the website ‘www.JobRoad.be’ (hereinafter referred to as the ‘Website’).JobRoad takes the privacy of Data Subjects very seriously. Any (personal) data obtained by JobRoad will be adequately and carefully protected.Please read this Privacy Statement carefully as it contains your rights with regard to JobRoad.

    This Privacy Statement may be revised or updated regularly. We advise you to review it regularly.

  • JobRoad complies with European Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (better known as the ‘GDPR’ or ‘GDPR’), as well as the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, and the anti-spam provisions of Book XII of the Economic Law Code on the ‘law of the electronic economy’ (where applicable).

JobRoad processes personal data from different categories of persons:

    • who in any other way leave data with JobRoad in order to be able to use JobRoad’s services,

In general, you are not obliged to provide your personal data. However, for the provision of certain services, the provision of personal data is legally or contractually necessary and it is therefore impossible to provide these services if you refuse to provide the relevant personal data.

3.2 Duration of processing

JobRoad stores and processes personal data for a period necessary for the purposes of processing as described in Article 3:

Data relating to candidates The following actions are carried out with regard to candidates’ personal data:

  • Five years after the last contact between the candidate and JobRoad, the candidate’s contact details (see Article 3.1.1), account number, CV and other documents created by JobRoad/candidate will be permanently deleted from and the candidate’s file will be marked as inactive and fully archived.
  • 10 years after the last contact, the candidate’s other personal data will be permanently deleted.

 

Data relating to applicants for internal vacancies JobRoad retains the personal data of applicants for internal vacancies for 5 years after the last contact with the applicant.

 

Data relating to clients and business relations JobRoad retains the personal data of clients, customers or other business relations for 10 years after the last contract.

 

 

The personal data mentioned is retained in accordance with specific legal requirements, such as applicable limitation periods (with regard to commercial claims/discrimination claims/etc.).

Article 4 – Transfer to third parties

4.2 Transfer of data within the group

JobRoad is part of the House of HR group, which includes various companies active in the field of recruitment and human resources. This includes the following Belgian brands: Accent, CTRL-F, Nowjobs, Sixie and Talent Lab. JobRoad will share the personal data it processes with other companies within the House of HR group in the context of intra-group cooperation and/or intra-group services in order to improve, facilitate and simplify the activities and services of JOBROAD and the House of HR group (e.g. ICT services, accounting, analyses and statistics, credit management, direct marketing, etc.).

In certain cases, JobRoad may act as joint controller together with other companies of the House of HR group:

  • JobRoad and Accent Jobs for People NV, Accent Construct NV, Accent Jobs NV, Nowjobs NV, CTRL-F NV act jointly as controllers for the processing of personal data in the context of database management. This means that the organisations jointly determine the purposes and means of processing candidates’ personal data for the maintenance and management of the joint database.

The joint controllers have entered into an agreement pursuant to Article 26 of the GDPR, which sets out the specific rights, obligations and responsibilities of each controller with regard to joint controllership. This means that they jointly determine the purpose of the means for processing your personal data within the framework of the above-mentioned purposes. In this case, they are jointly responsible for compliance with the applicable data protection legislation. However, JobRoad remains your main point of contact, including for the exercise of your rights with regard to your personal data (for more information on the exercise of your rights, see Article 5).

4.3 Transfer to third countries

JobRoad may transfer your personal data outside the European Economic Area in order to process the data in accordance with this privacy statement. In the event that data is transferred outside the European Economic Area to a country that is not recognised as providing an adequate level of protection, JobRoad will take the necessary measures to ensure that the data transfer takes place in accordance with the GDPR (such as the implementation of contractual provisions that provide sufficient safeguards for data protection for the data that will be transferred internationally, contractual provisions, binding corporate rules, exceptions as provided for in Article 49 of the GDPR). For the following purposes, JobRoad transfers your personal data (mainly identification data) to parties located outside the European Economic Area: administration and management of staff and intermediaries, customer management and public relations. For these processing operations, adequacy decisions (UK, US) exist, or JobRoad has concluded standard contractual clauses and carried out a transfer impact assessment and taken measures to reduce privacy risks (US).

Article 5 – Your rights

You always have the right to request JobRoad to access, restrict, correct or delete your personal data. You have the right to withdraw your consent, object to the processing of your personal data or request JobRoad to transfer this data.

You can exercise your rights by contacting JobRoad (contact details can be found in Article 9). If JobRoad has reasonable doubts about your identity, JobRoad may ask you to prove your identity in order to prevent anyone from gaining unauthorised access to your data.

JobRoad is not always obliged to comply with your request to exercise your rights – your rights only apply in the cases and to the extent provided for by the GDPR.

You also have the right to lodge a complaint with a supervisory authority. For Belgium, this is the Data Protection Authority.

Article 6 – Security and confidentiality

JobRoad has developed security measures that are adapted on a technical and organisational level to prevent the destruction, loss, falsification, alteration, unauthorised access or accidental disclosure to third parties of personal data collected, as well as any other unauthorised processing of this data.

In order to process your personal data, JobRoad grants its employees access to your personal data.

JobRoad will enforce a similar level of protection through contractual obligations – similar to this Privacy Statement – against its employees and appointees. In concrete terms, this means that JobRoad’s employees and appointees are bound by confidentiality and that only those for whom it is necessary for the performance of their duties will have access to your personal data.

JobRoad may amend this Privacy Statement from time to time. To keep you informed of the latest changes to our Privacy Statement, JobRoad will update the revision date each time it is amended. The amended Privacy Statement will take effect on that date.
